Advice for Employees You have been referred by your manager, or HR department to Peak Occupational Health in Whaley Bridge for an Occupational Health assessment based on your company employment. We are located at 7 Market Street, Whaley Bridge High Peak sk23 7AA. The what3words are; debater.publish.escapades. This advice sheet is aimed at assisting you to understand what to expect from this appointment. Please ensure that you are fully aware of the reason for your referral to us and that you have been given the opportunity to discuss this with your manager. You will be asked to sign a consent form by your manager agreeing to this assessment. This is a routine process, but if you are not happy to be referred, you have the right to refuse your consent. Please ensure that you bring your latest Job Description with for your first appointment. Please also bring with you details and dates of any previous employment you may have undertaken, and a list of medication you are taking. You will be asked to complete a registration form at your first attendance with us. This includes your full name, address and contact telephone number. All personal details requested on this form are kept completely confidential by Peak Occupational Health. Please make sure your details are accurate and up-to-date including the name and contact details of your GP. Please note you are unable to change, or cancel your appointment personally. All appointments are made by your company as your employer. Any changes to appointments must be done through your line manager. All personal information that you impart to any member of the team at Peak Occupational Health is treated with respect, stored securely and remains completely confidential. Depending on what type of assessment you have been referred for, you may be asked to undress for an examination, or requested to assist with a relevant practical/physical test related to your appointment. If you require a chaperone, please make this clear at your appointment. All assessment results and reports provided by Peak Occupational Health are unbiased, independent and undertaken in the strictest confidence. We are not party to any internal company policing, or disciplinary process. You are entitled to read a copy of any report we produce about you and you will always be asked for your signed consent before any report about you is submitted to your manager, or company. If you do not give your consent, your report will not be sent, but your company is then allowed by law to proceed with your case following company policy, without your report. We may need to obtain further information from your GP or hospital Consultant. If this is required, we will ask for your consent to contact any third party before any request for information is made. We may suggest that you are referred to another third-party professional for further treatment. This will only take place with your agreement, consent and company engagement. You will not be charged for your appointments. Charges are made through your company as your employer. If you miss or do not attend an appointment however, you may be liable to a charge under your company rules. Terms & Conditions Companies are required to sign a contract before they can proceed with referring any employee. Referrals will only be accepted from Company Managers, Company Directors, Health & Safety Managers, or HR Managers for the Company Employer. Employees must be fully informed about their referral for Occupational Health Assessment at Peak Occupational Health. Each referral must be accompanied by the employee’s signed consent form. All Risk Assessments remain the responsibility of the employing company and should be made available to Peak Occupational Health on request. Opening times are Tuesdays, Wednesdays and Thursdays 9.00 a.m. – 4.00 p.m. We will only answer calls and emails between the hours of 9.30 a.m. and 4.00 p.m. We will have a phone message facility available outside working hours. We have a strict Cancellation Policy. Signing the contract commits the referring company to a minimum of 24hrs notice to cancel, or change an appointment. The arrangements and administration of appointments, remains the responsibility of the referring company. Full costs will be made for employee failure to attend an appointment, or cancellations made without 24hrs notice. Travel costs are 45p per mile, and will be added to invoices for on-site visits made by Peak Occupational Health. Payment of costs incurred obtaining medical reports from Consultant Specialists and/or GP’s, and agreed onward referrals to other Specialists, or referral to an Occupational Health Physician must be paid by the referring company and will be added to the monthly invoice. Invoicing will be on a monthly basis and have a strict payment term of 30 days from the date of the invoice, by BACS transfer. Payments that fall outside the 30-day payment policy will incur a 15% interest charge per 15 working days of late payment. Medical Reports and Certificates will only be submitted to the referring company after full payment of all outstanding invoice(s). All costs are reviewed on an annual basis and will be communicated to the referring company in advance. Peak Occupational Health reserves the right to claim expenses and terminate any contract where invoices remain unpaid after three months.

About Us Peak Occupational Health’s mission is to provide a trusted and reliable Occupational Health Service for all our clients, and to deliver a cost-effective, personalised service which strives to maximise and improve the health, safety and wellbeing of employees in the workplace. The Team Carolyn and Wendy have been colleagues and friends for the last 15 years, jointly providing Occupational Health and Physiotherapy services for many diverse industries in and around the High Peak. Together they have consistently delivered a highly respected and greatly appreciated service, and with their wealth of experience, they are well equipped to expand their professional services to a much wider audience. Peak Occupational Health in Whaley Bridge is therefore Wendy and Carolyn’s new and expanding business which offers quality health surveillance for small and medium sized companies, at a competitive cost. Carolyn Marks - MSc , MCSP, MACP, Cert OH Qualified as a Chartered Physiotherapist in Birmingham. She worked as a clinician specialising in Musculoskeletal Injuries and Rehabilitation in the NHS for 22 years. Carolyn became Therapy Services Manager at the Royal Orthopaedic Hospital NHS Trust. Alongside this, she managed her own Private Physiotherapy Practice which provided treatment rehabilitation to employees in industry. She then moved into Physiotherapy within Occupational Health in Industry and has 15 years’ extensive experience in treating patients in Manufacturing. Wendy Turner - MSc , RGN, OHNC Qualified as a Registered Nurse at Manchester Royal Infirmary. Wendy then worked in the NHS for 15 years in Coronary Care, after which she transferred into training for Nursing within Occupational Health gaining 20 years extensive training and experience in both the public and private sectors within Manufacturing, and Pharmaceuticals. We have a range of supporting policies/documents that help our staff understand how to deliver client care to a consistently high standard. Our client care processes include: Providing a professional yet friendly service at all times. Ensuring sensitive/confidential information is dealt with in accordance with our Data Protection Policy. Staff training and regular updates regarding aspects of work such as telephone etiquette and understanding our business, to ensure that telephone calls are dealt with in an efficient, respectful and confidential manner. Supporting, developing and valuing our staff so that they can deliver the highest possible standard of client care each time they deal with a query or workflow process. Offering a diverse assessment and rehabilitation service, which aims to meet the needs of most clients referred into us. Where necessary, we are able to source translation services, and ensure that an individual client’s cultural and/or religious beliefs are taken into consideration. Ensuring that where a client’s assessment rehabilitation needs are not able to be met by the business, we will communicate this effectively and efficiently. Where possible, we will advise of an alternative provider who we believe may be able to offer a professional solution. Data Protection & GDPR Policy Policy Statement This is the statement of the General Data Protection Regulations Policy (GDPR) adopted by Peak Occupational Health. The policy is subject to regular review annual to reflect any changes to legislation, structure and policies within the business. Peak Occupational Health is required to collect personal data information in order to operate as a business. Personal details can include that of individuals referred to the business, staff members, and third-party professionals. Data must be processed, and held in line with the Data Protection Act 1998 and GDPR. Peak Occupational Health regard the lawful management of personal data as important to the achievement of the business’s objectives and to maintain confidence between those we deal with and the business. Peak Occupational Health fully endorses the principles that are laid down in law and will ensure compliance with the British standard for Data Protection: BS 10012. GDPR Policy Personal data will be obtained, maintained, stored, used and passed to third-party individuals in strict accordance with the Data Protection Act 1998. This includes the following processes; The business will limit the collection of data to that which is only necessary for valid business purposes, in a way which complies with the law and is obtained by lawful and fair means. The business will strive to maintain only accurate personal data. The business will not release personal data to a third-party unless the individual to which the data relates has given their written consent for this, or the law requires disclosure. The business will take all appropriate steps to ensure that personal data is protected from unauthorised access and disclosure, including limiting access to such data to professional staff on a need-to-know only basis. The Principles of GDPR The Data Protection Act 1998/GDPR stipulates that anyone processing personal data must comply with eight principles of good practice. It is essential that Peak Occupational Health fully complies with these principles in order to avoid prosecution, bad publicity and resultant lack of company confidence in the business. A breach of the Act can lead to fines and claims for compensation. The following eight principles apply; Personal Information must; Be processed fairly and lawfully and in particular shall not be processed unless specific conditions are met. Be obtained only for one or more specified and lawful purposes and must not be further processed in any manner incompatible with that purpose, or those purposes. Be adequate, relevant and not excessive in relation to the purpose to the purpose or purposes for which it is processed. Be accurate and where necessary and possible, kept up-to-date. Not be kept for longer that is necessary for that purpose, or purposes. Be processed in accordance with the rights of the data subjects under the Act. Be kept secure and protected by a degree of reasonable security. Not transferred to any country, or territory outside the United Kingdom unless the country or territory ensures an adequate level of data protection security. The eight principles of GDPR are legally enforceable. The Act provides conditions for the processing of personal data and makes a distinction between personal data and sensitive personal data. Definitions Personal Data is defined as data relating to a living individual who can be identified from; The data and other information which is in the possession of, or is likely to come into the possession of the data controller and includes an expression of opinion about the individual and any indications of the intentions of the data controller, or any other person in respect of that individual. A data controller is a person who determines the purpose(s) for which the manner in which any personal data are, or are to be processed. The Data Protection Act 1998 covers both electronic and paper-based information. Sensitive data information relating to; racial or ethnic origin, religious or similar beliefs, trade union membership, physical or mental health or sexual orientation, political beliefs and opinions, or criminal offenses can only be held in strictly defined situations, or where explicit consent has been obtained. Collecting Personal Data When collecting personal data at Peak Occupational Health, individuals must know the following; Who we are. What the business is. What any personal data will be used for. To whom personal data will be disclosed. Initial personal data will be collected by the Referral Form and then the Registration Form. Handling Personal Information When handling, collecting, processing personal data, Peak Occupational Health personnel must ensure; All personal data is accurate and up-to-date. Errors are corrected effectively and promptly. The data is deleted and destroyed confidentially when it is no longer required. All personal data is kept secure in a lockable cabinet and locked away at the end of the working day. The Data Protection Act is considered when setting up new systems, or personal data is required for new purposes. Written consent is always obtained if third-party referral is required. Personal data information is sent securely and password protected. Ensure all company contracts and referrals are accompanied by an explicit specification that all data must be handled securely by the company under the Act. It is recognised that; Peak Occupational Health staff will not access personal data not required strictly for work purposes. Staff will not use data for any other purpose, but that for which it was explicitly obtained. Staff will not store, process or handle sensitive personal data unless they are confirmed as entitled to do so and have had written consent from the individual it relates to. Sensitive Data Sensitive data is personal data that contains information relating to; Racial or ethnic origin. Political views and opinion. Religious or other beliefs. Trade Union Membership. Physical or Mental Health conditions (incl Medical Records). Sexual Orientation. Criminal Proceedings, or convictions. When handling personal sensitive data, Peak Occupational Health staff will manage the information using strict criteria and controls including; Observe conditions regarding the fair collection and use of such sensitive data. Meet the legal obligations specifying the purpose for which the information is required. Collect and process only information that is required to fulfil the operational requirements of the company. Ensure the accuracy of information used. Apply 7year rule for retaining personal data, and ensure the information is destroyed in a timely and confidential manner. Take appropriate organisational security measures to ensure that personal data is kept securely on site. Ensure that any personal information is never transferred abroad without suitable safeguarding. Ensure that the rights of individuals to whom the information relates are respected and fully adhered to under the Act. The rights of individuals include; The right to be informed. The right of access. The right to rectification. The right to erasure. The right to restrict processing. The right to data portability. The right to object. The right to deny consent. The right not to be subject to automated decision-making including profiling. In addition, Peak Occupational Health staff will ensure that; There is a senior staff member responsible for data protection. All staff managing and handling personal information understands that they are contractually responsible for following good data protection protocols. Queries about handling of personal information are promptly, efficiently and courteously dealt with. Methods of handling personal information at Peak Occupational Health are regularly assessed and evaluated for good practice. Everyone managing and handling personal information is appropriately informed, trained and supervised. Data sharing is only carried out under written consent, setting out the scope and limits of the data sharing. Verbal consent must be documented by the staff member. All sharing of personal data is compliant with approved procedure. All staff at Peak Occupational Health are made aware of the policy content and understand their duties and responsibilities under the Act. Protecting Data All staff at Peak Occupational Health will take steps to ensure that personal data is kept secure at all times, to protect it from unauthorised, or unlawful loss or disclosure; Personal Data files are stored and locked in filing cabinets designated for that function. Personal data held electronically is password protected. Computer passwords are not easily compromised. All contractors and other agents visiting Peak Occupational Health; Must be made aware of their duties and responsibilities under the Act. Allow data protection audit to be undertaken without objection or interference. Any breach of data will be viewed as a breach of contract between Peak Occupational Health and the contractor. Indemnify Peak Occupational Health against any prosecutions, claims, proceedings, actions or payments of compensation where they have breached confidentiality of data. Not transfer personal data outside the UK, unless by special measures. Subject Access and Subject Rights Individuals whose personal data is held by Peak Occupational Health have the right to; Receive on request, details of the processing of data related to themselves. Have any inaccuracies in personal data removed, or corrected. Deny consent to processing where this is likely to cause substantial damage or substantial distress. Prevent data from being used for marketing or advertising. Other Relevant Legislation General Data Protection Regulations. Data Protection Act 1998. Access to Medical records 1990. Access to Medical reports 1988. Crime and Disorder Act 1998. Notification to the Information Commissioner (ICO) The ICO maintains a public register of data controllers. Peak Occupational Health is registered with the ICO. The GDPR requires every data controller who is processing personal data to notify and renew their notification on an annual basis. Failure to do so is a criminal offence. Designated officer in Peak Occupational Health is responsible for notifying and updating the ICO. Any changes to the register must notified within 28days. Retention of Data Personal data relating to clients at Peak Occupational Health must be kept securely and maintained for a minimum of 7 years. This coincides with legal requirements and professional standards. For clients under the age of 18yrs, personal data must be kept until the client reaches the age of 25yrs. Research Purpose Exemption Data collection collected fairly and lawfully can be used for research, providing the research does not identify the individual(s) concerned. Such data must not be processed to support measure of decisions with direct consequences for any individual concerned, or in any way that is likely to cause substantial damage or distress to the data subject. This exemption is only applicable to academic research. Breach of Personal Data Protection Any breach in personal data protection will be investigated in line with the Department of Health’s checklist for reporting; Managing and Investigating Information Governance Serious Untoward Incidents gateway ref; 13177. The number and categories of the breach(es) will be brough to the attention of the proprietors of Peak Occupational Health. Disciplinary procedures may be appropriate for the member of staff responsible for the breach. The ICO must be contacted where feasible, within 72 hours where the beach is likely to result in a risk to rights and freedom of individuals, for example discrimination, damage to reputation, financial loss, loss of confidentiality or significant economic or social disadvantage. Clinical Assessments Physiotherapy Assessments Advice on musculoskeletal related absence, including active physiotherapy treatment. Audiometry Assessments For employees exposed to noise levels above 85 decibels. Spirometry Assessments For employees working with wood dust, glues and resins, colophony, silica, flour, solvents, workplace sensitizers, mineral/cutting fluids etc. New Starter Medical Assessments It is prudent to offer New-Starter Assessments to all potential employees to ensure that any adjustments required by that individual for disability are implemented by the company, prior to them commencing work. Qualitative Mask Fit Testing This is a simple, subjective pass/fail test for respiratory protection equipment (disposable and reusable half masks) to ensure that they are fit for purpose, seal around the face and therefore protect the user from harmful dust or fumes. Drug & Alcohol Testing We can provide drug and alcohol testing (urine and breath test analysis) either for pre-employment purposes, or in response to due company concern (reasonable suspicion, or post-accident incident). We can provide this as an onsite service if required. Personal Hygiene Testing for Food Preparation These assessments involve medical tests, checking immunisation records and physical examination, to ensure that employees working in the food industry are free from conditions that can transmit food born illnesses. Advice Welcome to our Advice page. It is important when receiving or enquiring about Occupational Health services that all individuals understand what is required to be assessed by law, but also any rights reserved by individuals. Advice for Managers Advice for Employees Advice from HSE Advice for Functional Capacity Assessment Fitness-to-Work Tiers for Assessment Advice for Mask-Fit Testing Job Specific Advice The Control of Substances Hazardous to Health (COSHH) Regulations 2002 and Management of Health and Safety at Work Regulations 1999 provide the framework for the Health Surveillance requirements in the UK. The Health & Safety Executive (HSE) requirements for health surveillance vary significantly between different trades and workplace hazards. Under the HSE there are trades requiring Mandatory Health Surveillance where it is a legal requirement for these industries to ensure correct health surveillance checks for all their workers. These include; Construction and Industrial Businesses ; for example, workers using vibration tools, Asbestos workers, Stonemasons, Foundry workers and Lead workers, Employees in Chemical and Laboratory Work ; employees exposed to carcinogens (cancer producing) or mutagens (cause mutations) , or substances toxic to reproduction and those in work where they are handling biological agents. Staff in Healthcare ; Radiographers exposed to radiation, workers handling cytotoxic drugs and those at risk of exposure to bloodborne pathogens. Workers in Agriculture ; those individuals exposed to pesticides, or Zoonotic disease from sheep. Workers in General Industries ; Compressed Air workers (divers, caisson workers), workers exposed to loud noise above action level and shift workers in safety critical roles. Sensitizers are substances that can cause an allergic reaction in the lungs and/or skin after exposure. There are numerous sensitizers in existence, but once an individual is allergic to one or several of these, even a minute amount of a substance can cause a severe reaction such as Occupational Asthma, or Contact Dermatitis. All employers must provide appropriate health surveillance where there is reasonable likelihood that disease, or ill-health may occur and valid surveillance techniques exist. In addition to the list above, other industries are also recommended to undertake health surveillance checks on their workforce.
