Complaints Procedure Peak Occupational Health is committed to providing a high-quality service to all our clients, but when something goes wrong, we take it seriously and view it as an opportunity to improve our standards. We greatly value our relationship with our clients and endeavour to address and resolve any complaint against us quickly to everyone’s satisfaction. If a client Company or employee raises a complaint then we ask for the details of the complaint and endeavour to address as set out in this policy; 1. If a client would like to speak to someone about a complaint, they should phone us directly and be passed to the most appropriate/ senior member of the team for an initial discussion. 2. If for any reason the most appropriate member of our team is not available, then they should able to leave a message and we will respond where possible, within 1 working day. 3. We may during discussion, ask for the complaint to be put in writing (email). It is then easier to address the details and circumstances of the compliant, or allow it to be passed to another member of staff who is more appropriate to deal with the complaint directly. Details in the email should include; a. A brief background leading up to the complaint (Date/Time) b. Who was involved c. Precisely what the complaint is about d. What action is required to resolve the complaint. 4. On receiving a complaint in writing, POH will acknowledge receipt by email within three working days, and enclose a copy of our Complaints Procedure. 5. POH will then investigate the complaint by; a. Ensuring the complaint is seen by a senior member of staff. b. Completing our investigation within one week of receiving the complaint. 6. If POH is not able to resolve the compliant within one week, we will invite specific Company Management Personnel to meet with us to discuss the matter further in order to; a. Resolve all complaints to the satisfaction of all parties. b. Learn from the process. c. Retain our relationship with the Client Company and its employees. 7. POH does accept that not all complaints will result in a satisfactory conclusion. If we are unable to do this, then we will; a. Arrange for an independent professional to review the matter, and act as an advocate in order to resolve the compliant. b. Advice for Functional Capacity Assessment You have been referred for a Functional Capacity Assessment by your employer. This assessment is aimed to ensure that the demands of your job role are not too hard, or too easy for your personal abilities. It is an unbiased report based on answers to specific questions and also practical tasks selected by the assessor, suitable to your line of work. We wish to give you advice as to what to expect when you attend Peak Occupational Health for this assessment. We may also advise your employer that we need to visit your place of work to see exactly what skills you require to undertake the job. Peak Occupational Health office is at 7, Market Street, Whaley Bridge, High Peak Derbyshire SK23 7AA. The What3words are; ///debater.publish.escapades. Please arrive on time for your appointment. Failure to do so, may mean that you are not able to complete all the tests required at that visit. You will be required to complete a signed consent form before your first appointment. Please ensure your manager has given this to you. It can be emailed to us at contact@peakoccupationalhealth.com or brought with you at your first visit. You will be required to complete some paperwork and possibly some questionnaires. If you wear glasses, please remember to bring these with you. The assessment may include you undertaking some practical tasks. It is advisable that you wear loose fitting clothing and comfortable trainers. The assessment can take between 2-4 hours. Please allow time for this and ensure that your manager is aware of the time required if you are attending during the working day. Please bring you a list of any medication you are taking. Please ensure that you inform the assessor of any medical problems you have, or have experienced in the past. We may possibly take your Blood Pressure and Heart Rate during the assessment, so loose clothing is advisable. If we are required to visit your place of employment, we will do this at a time that is suitable to you, your employer and line manager. We will be writing a report following the completion of your assessment. You will be given the opportunity to read this report before it is sent to your manager, or HR department. Ensuring that where a client’s assessment rehabilitation needs are not able to be met by the business, we will communicate this effectively and efficiently. Where possible, we will advise of an alternative provider who we believe may be able to offer a professional solution. Data Protection & GDPR Policy Policy Statement This is the statement of the General Data Protection Regulations Policy (GDPR) adopted by Peak Occupational Health. The policy is subject to regular review annual to reflect any changes to legislation, structure and policies within the business. Peak Occupational Health is required to collect personal data information in order to operate as a business. Personal details can include that of individuals referred to the business, staff members, and third-party professionals. Data must be processed, and held in line with the Data Protection Act 1998 and GDPR. Peak Occupational Health regard the lawful management of personal data as important to the achievement of the business’s objectives and to maintain confidence between those we deal with and the business. Peak Occupational Health fully endorses the principles that are laid down in law and will ensure compliance with the British standard for Data Protection: BS 10012. GDPR Policy Personal data will be obtained, maintained, stored, used and passed to third-party individuals in strict accordance with the Data Protection Act 1998. This includes the following processes; The business will limit the collection of data to that which is only necessary for valid business purposes, in a way which complies with the law and is obtained by lawful and fair means. The business will strive to maintain only accurate personal data. The business will not release personal data to a third-party unless the individual to which the data relates has given their written consent for this, or the law requires disclosure. The business will take all appropriate steps to ensure that personal data is protected from unauthorised access and disclosure, including limiting access to such data to professional staff on a need-to-know only basis. The Principles of GDPR The Data Protection Act 1998/GDPR stipulates that anyone processing personal data must comply with eight principles of good practice. It is essential that Peak Occupational Health fully complies with these principles in order to avoid prosecution, bad publicity and resultant lack of company confidence in the business. A breach of the Act can lead to fines and claims for compensation. The following eight principles apply; Personal Information must; Be processed fairly and lawfully and in particular shall not be processed unless specific conditions are met. Be obtained only for one or more specified and lawful purposes and must not be further processed in any manner incompatible with that purpose, or those purposes. Be adequate, relevant and not excessive in relation to the purpose to the purpose or purposes for which it is processed. Be accurate and where necessary and possible, kept up-to-date. Not be kept for longer that is necessary for that purpose, or purposes. Be processed in accordance with the rights of the data subjects under the Act. Be kept secure and protected by a degree of reasonable security. Not transferred to any country, or territory outside the United Kingdom unless the country or territory ensures an adequate level of data protection security. The eight principles of GDPR are legally enforceable. The Act provides conditions for the processing of personal data and makes a distinction between personal data and sensitive personal data. Definitions Personal Data is defined as data relating to a living individual who can be identified from; The data and other information which is in the possession of, or is likely to come into the possession of the data controller and includes an expression of opinion about the individual and any indications of the intentions of the data controller, or any other person in respect of that individual. A data controller is a person who determines the purpose(s) for which the manner in which any personal data are, or are to be processed. The Data Protection Act 1998 covers both electronic and paper-based information. Sensitive data information relating to; racial or ethnic origin, religious or similar beliefs, trade union membership, physical or mental health or sexual orientation, political beliefs and opinions, or criminal offenses can only be held in strictly defined situations, or where explicit consent has been obtained. Collecting Personal Data When collecting personal data at Peak Occupational Health, individuals must know the following; Who we are. What the business is. What any personal data will be used for. To whom personal data will be disclosed. Initial personal data will be collected by the Referral Form and then the Registration Form. Handling Personal Information When handling, collecting, processing personal data, Peak Occupational Health personnel must ensure; All personal data is accurate and up-to-date. Errors are corrected effectively and promptly. The data is deleted and destroyed confidentially when it is no longer required. All personal data is kept secure in a lockable cabinet and locked away at the end of the working day. The Data Protection Act is considered when setting up new systems, or personal data is required for new purposes. Written consent is always obtained if third-party referral is required. Personal data information is sent securely and password protected. Ensure all company contracts and referrals are accompanied by an explicit specification that all data must be handled securely by the company under the Act. It is recognised that; Peak Occupational Health staff will not access personal data not required strictly for work purposes. Staff will not use data for any other purpose, but that for which it was explicitly obtained. Staff will not store, process or handle sensitive personal data unless they are confirmed as entitled to do so and have had written consent from the individual it relates to. Sensitive Data Sensitive data is personal data that contains information relating to; Racial or ethnic origin. Political views and opinion. Religious or other beliefs. Trade Union Membership. Physical or Mental Health conditions (incl Medical Records). Sexual Orientation. Criminal Proceedings, or convictions. When handling personal sensitive data, Peak Occupational Health staff will manage the information using strict criteria and controls including; Observe conditions regarding the fair collection and use of such sensitive data. Meet the legal obligations specifying the purpose for which the information is required. Collect and process only information that is required to fulfil the operational requirements of the company. Ensure the accuracy of information used. Apply 7year rule for retaining personal data, and ensure the information is destroyed in a timely and confidential manner. Take appropriate organisational security measures to ensure that personal data is kept securely on site. Ensure that any personal information is never transferred abroad without suitable safeguarding. Ensure that the rights of individuals to whom the information relates are respected and fully adhered to under the Act. The rights of individuals include; The right to be informed. The right of access. The right to rectification. The right to erasure. The right to restrict processing. The right to data portability. The right to object. The right to deny consent. The right not to be subject to automated decision-making including profiling. In addition, Peak Occupational Health staff will ensure that; There is a senior staff member responsible for data protection. All staff managing and handling personal information understands that they are contractually responsible for following good data protection protocols. Queries about handling of personal information are promptly, efficiently and courteously dealt with. Methods of handling personal information at Peak Occupational Health are regularly assessed and evaluated for good practice. Everyone managing and handling personal information is appropriately informed, trained and supervised. Data sharing is only carried out under written consent, setting out the scope and limits of the data sharing. Verbal consent must be documented by the staff member. All sharing of personal data is compliant with approved procedure. All staff at Peak Occupational Health are made aware of the policy content and understand their duties and responsibilities under the Act. Protecting Data All staff at Peak Occupational Health will take steps to ensure that personal data is kept secure at all times, to protect it from unauthorised, or unlawful loss or disclosure; Personal Data files are stored and locked in filing cabinets designated for that function. Personal data held electronically is password protected. Computer passwords are not easily compromised. All contractors and other agents visiting Peak Occupational Health; Must be made aware of their duties and responsibilities under the Act. Allow data protection audit to be undertaken without objection or interference. Any breach of data will be viewed as a breach of contract between Peak Occupational Health and the contractor. Indemnify Peak Occupational Health against any prosecutions, claims, proceedings, actions or payments of compensation where they have breached confidentiality of data. Not transfer personal data outside the UK, unless by special measures. Subject Access and Subject Rights Individuals whose personal data is held by Peak Occupational Health have the right to; Receive on request, details of the processing of data related to themselves. Have any inaccuracies in personal data removed, or corrected. Deny consent to processing where this is likely to cause substantial damage or substantial distress. Prevent data from being used for marketing or advertising. Other Relevant Legislation General Data Protection Regulations. Data Protection Act 1998. Access to Medical records 1990. Access to Medical reports 1988. Crime and Disorder Act 1998. Notification to the Information Commissioner (ICO) The ICO maintains a public register of data controllers. Peak Occupational Health is registered with the ICO. The GDPR requires every data controller who is processing personal data to notify and renew their notification on an annual basis. Failure to do so is a criminal offence. Designated officer in Peak Occupational Health is responsible for notifying and updating the ICO. Any changes to the register must notified within 28days. Retention of Data Personal data relating to clients at Peak Occupational Health must be kept securely and maintained for a minimum of 7 years. This coincides with legal requirements and professional standards. For clients under the age of 18yrs, personal data must be kept until the client reaches the age of 25yrs. Research Purpose Exemption Data collection collected fairly and lawfully can be used for research, providing the research does not identify the individual(s) concerned. Such data must not be processed to support measure of decisions with direct consequences for any individual concerned, or in any way that is likely to cause substantial damage or distress to the data subject. This exemption is only applicable to academic research. Breach of Personal Data Protection Any breach in personal data protection will be investigated in line with the Department of Health’s checklist for reporting; Managing and Investigating Information Governance Serious Untoward Incidents gateway ref; 13177. The number and categories of the breach(es) will be brough to the attention of the proprietors of Peak Occupational Health. Disciplinary procedures may be appropriate for the member of staff responsible for the breach. The ICO must be contacted where feasible, within 72 hours where the beach is likely to result in a risk to rights and freedom of individuals, for example discrimination, damage to reputation, financial loss, loss of confidentiality or significant economic or social disadvantage. Terms & Conditions Companies are required to sign a contract before they can proceed with referring any employee. Referrals will only be accepted from Company Managers, Company Directors, Health & Safety Managers, or HR Managers for the Company Employer. Employees must be fully informed about their referral for Occupational Health Assessment at Peak Occupational Health. Each referral must be accompanied by the employee’s signed consent form. All Risk Assessments remain the responsibility of the employing company and should be made available to Peak Occupational Health on request. Opening times are Tuesdays, Wednesdays and Thursdays 9.00 a.m. – 4.00 p.m. We will only answer calls and emails between the hours of 9.30 a.m. and 4.00 p.m. We will have a phone message facility available outside working hours. We have a strict Cancellation Policy. Signing the contract commits the referring company to a minimum of 24hrs notice to cancel, or change an appointment. The arrangements and administration of appointments, remains the responsibility of the referring company. Full costs will be made for employee failure to attend an appointment, or cancellations made without 24hrs notice. Travel costs are 45p per mile, and will be added to invoices for on-site visits made by Peak Occupational Health. Payment of costs incurred obtaining medical reports from Consultant Specialists and/or GP’s, and agreed onward referrals to other Specialists, or referral to an Occupational Health Physician must be paid by the referring company and will be added to the monthly invoice. Invoicing will be on a monthly basis and have a strict payment term of 30 days from the date of the invoice, by BACS transfer. Payments that fall outside the 30-day payment policy will incur a 15% interest charge per 15 working days of late payment. Medical Reports and Certificates will only be submitted to the referring company after full payment of all outstanding invoice(s). All costs are reviewed on an annual basis and will be communicated to the referring company in advance. Peak Occupational Health reserves the right to claim expenses and terminate any contract where invoices remain unpaid after three months.

Fitness-to-Work Tiers for Assessment At Peak Occupational Health we have four tiers of Fitness-to-Work Assessment; If you have any doubt as to the level required for your employee, please call the office for advice on Tel; 01663 738686. The four levels are as follows; 1) Return-to-work advice; this is appropriate for employees who have been absent from work and management need to understand when the individual will be able to return to work and what adjustments they might require within their job role. It will require job role evaluation, and an Occupational Health Nurse clinical assessment. Cost £150. Time required 60 mins. 2) Musculoskeletal Clinical Assessment; this is appropriate for employees suffering with musculoskeletal conditions such as back/neck pain, shoulder, Knee or traumatic injury that is preventing them from returning to work. It also covers employees post musculoskeletal surgery (Hip or knee replacement, shoulder or knee surgery etc) It will involve a clinical assessment by a Musculoskeletal Physiotherapist with an indication of any adjustments required for this employee to return to work. Cost £150. Time required 60 mins. 3) Detailed Fitness- to-Work Assessment; this is an assessment of an employee’s ability to perform their job role. It includes biomedical, psychological and social reviews. The employee will be clinically assessed by a Occupational Health Nurse and if necessary, a Musculoskeletal Physiotherapist. The employee will complete validated psychosocial questionnaires. The report given to management will include identification of any Yellow, Blue and Black Flags found during the assessment and a action plan for rehabilitation of the employee back to work. Cost £200. Time required 2 hours. 4) Full Functional Assessment of Fitness and Capacity to Work; this is a full biopsychosocial assessment of an individual’s ability to fulfil their job role. It involves job role analysis, clinical assessment by both an Occupational Health Nurse and Physiotherapist. The employee will complete validated questionnaires and appropriate functional assessment tests. Level 4 also includes a site visit to assess an employee at their place of work. The report will include an action plan. Cost £400 + Travel 45 ppm. Time required up to 4 hrs. *Please note – Assessments 1-3 might reveal that further in-depth investigation, or additional tests may be required. Access Policy Peak Occupational Health office is based in the centre of Whaley Bridge High Peak and serves all companies locally and all those based within Derbyshire and Cheshire. Peak Occupational Health is committed to providing access to Occupational Health assessment services to all company employees requiring Health Surveillance under the directive of the HSE and COSHH regulations UK. We believe in equal access for all. The office is located near Whaley Bridge railway station on the Buxton-Stockport railway line. There is parking for cars at the rear and front of the building. Parking restrictions apply under local authority rules. Bus routes run through Whaley Bridge linking the location to other villages and the towns of Macclesfield and Stockport. Individuals who require an interpreter can be accommodated with agreement from their company employer. All company employees are welcome into the Peak Occupational Health assessment service, once their company is under contract with Peak Occupational Health. Any employee/ staff request for referral to Peak Occupational Health should by made through their company Health & Safety, or HR Department. Advice for Managers This advice sheet is aimed at assisting company managers to make appropriate Occupational Health referrals to Peak Occupational Health in Whaley Bridge in line with UK Law and HSE requirements. Referrals to Peak Occupational Health will only be accepted from a company’s designated Manager (Client Company Manager, Human Resources Manager, or Health & Safety Manager). Please ensure that the reason for the referral is clearly and comprehensively explained to the employee, prior to their appointment date at Peak Occupational Health. An employee’s informed and signed consent for the referral, must be obtained and submitted to Peak Occupational Health by the referring Manager, prior to any appointment being made. As the referring Manager, please complete Peak Occupational Health Referral Form. This must be submitted together with the employee’s signed consent, by email to contact@peakoccupationalhealth.com 48hrs prior to an employee appointment. Please state on any referral what information you require from the employee assessment appointment. Examples of this may include; A certificate of competence for a particular job responsibility. A return-to-work assessment report, which includes a summary of any functional incapacity and suggestions for any adaptations, or changes in work environment required. An answer to whether an employee ill-health condition should be covered under the Disability Equality Act 2010. An assessment required for their employment by the HSE. Please ensure that the employee is given a copy of their Job Description to bring with them at their first appointment. Appointment dates and times can be arranged directly with Peak Occupational Health by phone Tel; 01663 738686, or email contact@peakoccupationalhealth.com and must be communicated to the employee by the company. Please note that arrangements and administration of appointments, remains the responsibility of the company. Please be aware that any missed appointments (for any reason) will be charged to the company at the normal rate and that cancellations can only be accepted up to 48hrs of the appointment date. Where it is not safe to travel for either party, the designated manager can re-arrange appointments with Peak Occupational Health without incurring additional cost. Please be aware that in unforeseen circumstances, Peak Occupational Health reserves the right to cancel appointments as far as possible in advance, and re-arrange these appointments at no cost to the company. Case review meetings can be requested by the referring Manager on-site. These will be charged to the company at an additional cost to any assessment. The company remains liable for timely payment of invoices. All assessment results and reports provided by Peak Occupational Health are unbiased, independent and undertaken in the strictest confidence. We are not party to any internal company policing, or disciplinary process. The company is responsible for informing POH within 30 days, if the designated referring Manager is no longer in post. - Advice for Mask-Fit Testing | Peak-Occupational-Health
Advice for Mask-Fit Testing (Managers & Employees) This is to help assist you with Mask-Fit tests required by your company, ensuring that the test runs smoothly and achieves the best possible outcome. Please read the following carefully; Please ensure you can confirm the date and time of your appointment. We allow 30 minutes for each appointment. Please ensure that you bring you mask with new filters to the test. Failure to do so, will mean that you will have to be re-booked for the test. The company will be liable for each appointment made. You will be required to complete consent forms at your first appointment. Please bring your glasses if you require them for reading. Please ensure you are clean shaven, with no sideburns, a maximum of 8 hours prior to the test time. If you do not wish to shave for personal or religious reasons, you will not be able to take the test. Please ensure that you do not eat, drink or smoke for a minimum of 30 minutes prior to the test. It is essential that your sense of taste is not affected by any other compound during the test. Chewing gum is also prohibited. Please note that if you lose weight, change job role, have major facial/dental surgery, or change your mask, you will require a Mask-Fit re-test within two weeks of your return to work. If you fail the test, we will be book you again for a re-test as soon as possible. You may be required to change your mask for a larger, or smaller size. You will need to discuss this with your manager before attending for your next appointment. If you fail your Mask-Fit test twice, you may be required to work with a battery-operated air-flow mask only. These masks use a battery run filtration system to ensure you are safe to operate in your area of work. These will be an additional, considerable cost to the company for this equipment. You will receive a pass/fail certificate at the end of the Mask-Fit test. Company policy dictates when a re-test is required (also see point 6). It remains a company’s responsibility to provide employees with the suitable mask for their job role in line with an appropriate Risk Assessment.
